Legislative background (REACH / CLP)


REGULATION (EC) No 1907/2006 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL (REACH): 

“A safety data sheet shall be provided free of charge on paper or  electronically no later than the date on which the substance or mixture is  first supplied.” (Article 31)

 

REGULATION (EC) No 1272/2008 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL (CLP): 

The supplier shall assemble and keep available all the  information used by that supplier for the purposes of  classification and labelling under this Regulation for a period  of at least 10 years after the substance or the mixture was last  supplied by that supplier. 

The supplier shall keep this information together with the  information required in Article 36 of Regulation (EC) No 1907/2006. (Article 49 of the CLP regulation). 

If you use the classification of substance/mixture determined by one of the members of the supply chain, then you should ensure that all the information required to the classification and labelling of the substance/mixture will be available for at least 10 years from the date of the last delivery of the substance/mixture.
