Commission Delegated Regulation (EU) 2024/197 enters into force

The COMMISSION DELEGATED REGULATION (EU) 2024/197, amending Regulation (EC) No 1272/2008 as regards the harmonised classification and labelling of certain substances, was published on 19 October 2023. The changes become mandatory from 1 September 2025.

Action required:

Annex VI to Regulation (EC) No 1272/2008 is amended as set out in the Annex to the Regulation. You must therefore verify whether the mixtures you manufacture, place on the market, or use contain any of the substances listed, and if so, ensure that the classification shown in your documentation is in line with the Regulation. If the classification on the SDS does not correspond to the Annex, an update will be necessary.

On the introduction of new hazard classes

Based on scientific knowledge and experience in identifying endocrine-disrupting substances hazardous to human health or the environment, as well as PBT, vPvB, PMT, and vPvM substances and mixtures, it became necessary to amend Regulation (EC) No 1272/2008.

The COMMISSION DELEGATED REGULATION (EU) 2023/707 (19 December 2022) added new hazard classes, corresponding hazard statements, and category codes to the CLP Regulation (1272/2008/EC).

Hazard categories for endocrine disruptors hazardous to human health

      1. Category 1 – ED HH1 – Danger – EUH380
      2. Category 2 – ED HH2 – Warning – EUH381

Hazard categories for endocrine disruptors hazardous to the environment

      1. Category 1 – ED ENV1 – Danger – EUH430
      2. Category 2 – ED ENV2 – Warning – EUH431

PBT (persistent, bioaccumulative and toxic) – Danger – EUH440

vPvB (very persistent and very bioaccumulative) – Danger – EUH441

PMT (persistent, mobile and toxic) – Danger – EUH450

vPvM (very persistent and very mobile) – Danger – EUH451

Action required:

Timeline for substances:

From 1 May 2025 at the latest, substances must be classified and labelled by Regulation (EU) 2023/707. Substances placed on the market before 1 May 2025 do not need to be reclassified or relabelled until 1 November 2026.

Timeline for mixtures:

From 1 May 2026 at the latest, mixtures must be classified by Regulation (EU) 2023/707. Mixtures placed on the market before 1 May 2026 do not need to be relabelled until 1 May 2028.

SVHC Candidate List expanded

On 25 June 2025, three new substances were added to the list. If these substances are present in the mixtures you manufacture, market, or use, action may be required.
