H351 (vd\u00fdchnutie)<\/strong>\u201c.<\/p>\n<p style=\"text-align: justify;\">Franc\u00fazsko a Eur\u00f3pska komisia podali proti rozsudku V\u0161eobecn\u00e9ho s\u00fadu odvolania, av\u0161ak S\u00fadny dvor Eur\u00f3pskej \u00fanie rozsudkom z 1. augusta 2025 v spojen\u00fdch veciach C-71\/23 P a C-82\/23 P odvolania zamietol a rozhodnutie V\u0161eobecn\u00e9ho s\u00fadu potvrdil.<\/p>\n<p style=\"text-align: justify;\">Ozn\u00e1menie C\/2025\/6670 v <a href=\"https:\/\/www.msds-europe.com\/wp-content\/uploads\/2025\/12\/OJ_C_202506670_SK_TXT.pdf\">\u00daradnom vestn\u00edku Eur\u00f3pskej \u00fanie<\/a> stanovuje praktick\u00e9 d\u00f4sledky s\u00fadnych rozhodnut\u00ed pre pr\u00edlohu VI nariadenia CLP.<\/p>\n<p style=\"text-align: justify;\">D\u00f4sledkom je, \u017ee harmonizovan\u00e1 klasifik\u00e1cia \u201e<strong>Carc. 2; H351 (vd\u00fdchnutie)<\/strong>\u201c zaveden\u00e1 na z\u00e1klade nariadenia (E\u00da) 2020\/217 pre <strong>oxid titani\u010dit\u00fd v pr\u00e1\u0161kovej forme obsahuj\u00faci \u010dastice s aerodynamick\u00fdm priemerom \u2264 10 \u03bcm v koncentr\u00e1cii najmenej 1 %<\/strong> <strong>definit\u00edvne zanikla<\/strong> a pr\u00edslu\u0161n\u00e1 polo\u017eka v tejto podobe mus\u00ed by\u0165 z pr\u00edlohy VI nariadenia CLP odstr\u00e1nen\u00e1.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #333333;\">V nadv\u00e4znosti na rozsudok ECHA aktualizovala svoje registre:<\/span><\/strong><\/p>\n<ul>\n<li style=\"text-align: justify;\">harmonizovan\u00e1 karcinog\u00e9nna klasifik\u00e1cia oxidu titani\u010dit\u00e9ho bola odstr\u00e1nen\u00e1 z C&amp;L Inventory,<\/li>\n<li style=\"text-align: justify;\">z\u00e1znamy v Registry of Intentions boli tomu zodpovedaj\u00facim sp\u00f4sobom upraven\u00e9,<\/li>\n<li style=\"text-align: justify;\">usmernenie ECHA ku klasifik\u00e1cii oxidu titani\u010dit\u00e9ho bolo stiahnut\u00e9.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\">\u010co to znamen\u00e1 v praxi?<\/h2>\n<p style=\"text-align: justify;\">V praxi to znamen\u00e1, \u017ee v s\u00fa\u010dasnosti <strong>neexistuje v pr\u00edlohe VI nariadenia CLP \u017eiadny platn\u00fd harmonizovan\u00fd z\u00e1znam \u201eCarc. 2; H351 (vd\u00fdchnutie)\u201d pre oxid titani\u010dit\u00fd<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Spolo\u010dnosti m\u00f4\u017eu samozrejme <strong>na\u010falej vykon\u00e1va\u0165 vlastn\u00fa klasifik\u00e1ciu na vlastn\u00fa zodpovednos\u0165<\/strong>, ak na z\u00e1klade dostupn\u00fdch \u00fadajov a konkr\u00e9tneho pou\u017eitia v\u00fdrobku pova\u017euj\u00fa pr\u00edsnej\u0161iu komunik\u00e1ciu riz\u00edk za od\u00f4vodnen\u00fa.<\/p>\n<p style=\"text-align: justify;\"><strong>D\u00f4le\u017eit\u00e9 je,<\/strong> \u017ee odstr\u00e1nenie harmonizovanej klasifik\u00e1cie oxidu titani\u010dit\u00e9ho pod\u013ea <a href=\"https:\/\/www.msds-europe.com\/sk\/obsahov%c3%a9-a-form%c3%a1lne-prvky-karty-bezpe%c4%8dnostn%c3%bdch-%c3%badajov\/\">CLP<\/a> <strong>nem\u00e1 vplyv na z\u00e1kaz jeho pou\u017eitia ako potravin\u00e1rskej pr\u00eddavnej l\u00e1tky (E171)<\/strong>, ktor\u00fd vych\u00e1dza z osobitnej potravinovej legislat\u00edvy a stanoviska EFSA z roku 2021.<\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\">Najd\u00f4le\u017eitej\u0161ie inform\u00e1cie o oxide titani\u010ditom<\/h2>\n<p style=\"text-align: justify;\">Oxid titani\u010dit\u00fd (zn\u00e1my aj ako oxid tit\u00e1nu(IV); chemick\u00fd vzorec TiO\u2082) je biely jemnozrnn\u00fd pr\u00e1\u0161ok, ktor\u00fd sa v pr\u00edrode vyskytuje vo forme miner\u00e1lov rutilu alebo anatasu.<\/p>\n<p style=\"text-align: justify;\">Najd\u00f4le\u017eitej\u0161ie oblasti pou\u017eitia s\u00fa farby a laky a v\u00fdroba papiera a plastov, ktor\u00e9 spolu predstavuj\u00fa pribli\u017ene 80 % svetovej spotreby oxidu titani\u010dit\u00e9ho. \u010eal\u0161ie pigmentov\u00e9 aplik\u00e1cie, napr\u00edklad tla\u010diarensk\u00e9 farby, guma, kozmetick\u00e9 v\u00fdrobky a potraviny, predstavuj\u00fa e\u0161te nieko\u013eko percent.<\/p>\n<p style=\"text-align: justify;\">Zvy\u0161ok sa vyu\u017e\u00edva v in\u00fdch aplik\u00e1ci\u00e1ch, napr\u00edklad pri v\u00fdrobe technicky \u010dist\u00e9ho tit\u00e1nu, skla a sklokeramiky, elektrickej keramiky, kovov\u00fdch pat\u00edn, katalyz\u00e1torov, elektrick\u00fdch vodi\u010dov a chemick\u00fdch medziproduktov.<\/p>\n<p style=\"text-align: justify;\">Oxid titani\u010dit\u00fd je ob\u013e\u00fabenou zlo\u017ekou farieb; pod\u013ea odhadov sa nach\u00e1dza vo v\u00fdznamnej \u010dasti v\u0161etk\u00fdch komer\u010dn\u00fdch n\u00e1terov\u00fdch hm\u00f4t.<\/p>\n<p style=\"text-align: justify;\">V kozmetike sa v mal\u00fdch mno\u017estv\u00e1ch pou\u017e\u00edva ako zahus\u0165ovadlo a opacifik\u00e1tor, vo v\u00e4\u010d\u0161\u00edch mno\u017estv\u00e1ch potom pln\u00ed \u00falohu fyzik\u00e1lneho UV filtra v opa\u013eovac\u00edch kr\u00e9moch, ke\u010f\u017ee oxid titani\u010dit\u00fd dok\u00e1\u017ee filtrova\u0165 aj \u0161kodliv\u00e9 UV \u017eiarenie.<\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\">Oxid titani\u010dit\u00fd ako potravin\u00e1rska pr\u00eddavn\u00e1 l\u00e1tka (E171)<\/h2>\n<p style=\"text-align: justify;\">Na z\u00e1klade nariadenia (ES) \u010d. 1333\/2008 bol oxid titani\u010dit\u00fd predt\u00fdm povolen\u00fd ako potravin\u00e1rska pr\u00eddavn\u00e1 l\u00e1tka (farbivo) pod ozna\u010den\u00edm E171. Jeho \u00falohou bolo zv\u00fdrazni\u0165 farbu potrav\u00edn a zlep\u0161i\u0165 vizu\u00e1lny vzh\u013ead v\u00fdrobkov.<\/p>\n<p style=\"text-align: justify;\">V rokoch 2016 \u2013 2021 bolo publikovan\u00e9 ve\u013ek\u00e9 mno\u017estvo toxikologick\u00fdch \u0161t\u00fadi\u00ed so zameran\u00edm najm\u00e4 na \u0161ar\u017ee TiO\u2082 potravin\u00e1rskej kvality obsahuj\u00face aj nano\u010dastice. Stanovisko EFSA zverejnen\u00e9 6. m\u00e1ja 2021 dospelo k z\u00e1veru, \u017ee oxid titani\u010dit\u00fd u\u017e nemo\u017eno pova\u017eova\u0165 za bezpe\u010dn\u00fd ako potravin\u00e1rsku pr\u00eddavn\u00fa l\u00e1tku, najm\u00e4 preto, \u017ee genotoxick\u00fd \u00fa\u010dinok nebolo mo\u017en\u00e9 s dostato\u010dnou istotou vyl\u00fa\u010di\u0165.<\/p>\n<p style=\"text-align: justify;\">V d\u00f4sledku toho Eur\u00f3pska komisia prijala nariadenie (E\u00da) 2022\/63, ktor\u00fdm zmenila pr\u00edlohy II a III nariadenia (ES) \u010d. 1333\/2008: oxid titani\u010dit\u00fd (E171) bol odstr\u00e1nen\u00fd zo zoznamu \u00danie povolen\u00fdch potravin\u00e1rskych pr\u00eddavn\u00fdch l\u00e1tok. Pod\u013ea nariadenia je od 7. febru\u00e1ra 2022 zak\u00e1zan\u00e9 uv\u00e1dza\u0165 na trh nov\u00e9 potraviny s pr\u00eddavkom E171 a po 7. auguste 2022 u\u017e na trhu nemohli zosta\u0165 ani potraviny obsahuj\u00face t\u00fato pr\u00eddavn\u00fa l\u00e1tku.<\/p>\n<p style=\"text-align: justify;\">Z\u00e1kaz E171 teda zost\u00e1va v platnosti a je \u00faplne nez\u00e1visl\u00fd od aktu\u00e1lneho zru\u0161enia klasifik\u00e1cie oxidu titani\u010dit\u00e9ho pod\u013ea CLP pre priemyseln\u00e9 pou\u017eitie.<\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\">V\u00fdvoj klasifik\u00e1cie oxidu titani\u010dit\u00e9ho pod\u013ea CLP \u2013 stru\u010dn\u00fd preh\u013ead<\/h2>\n<p style=\"text-align: justify;\">Delegovan\u00e9 nariadenie Komisie (E\u00da) 2020\/217, prijat\u00e9 ako 14. ATP k nariadeniu CLP (ES) \u010d. 1272\/2008, bolo uverejnen\u00e9 v \u00daradnom vestn\u00edku Eur\u00f3pskej \u00fanie 18. febru\u00e1ra 2020 a bolo uplatnite\u013en\u00e9 od 1. okt\u00f3bra 2021.<\/p>\n<p style=\"text-align: justify;\"><strong>T\u00e1to zmena:<\/strong><\/p>\n<ul>\n<li style=\"text-align: justify;\">zaviedla nov\u00fd z\u00e1znam pre oxid titani\u010dit\u00fd v tabu\u013eke 3 \u010dasti 3 pr\u00edlohy VI nariadenia CLP a klasifikovala oxid titani\u010dit\u00fd v pr\u00e1\u0161kovej forme obsahuj\u00faci najmenej 1 % oxidu titani\u010dit\u00e9ho a \u010dastice s aerodynamick\u00fdm priemerom \u2264 10 \u03bcm ako karcinog\u00e9n kateg\u00f3rie 2 (Carc. 2; H351 \u2013 \u201ePodozrenie, \u017ee sp\u00f4sobuje rakovinu (vd\u00fdchnutie)\u201c);<\/li>\n<li style=\"text-align: justify;\">z\u00e1rove\u0148 zaviedla dve nov\u00e9 dopl\u0148uj\u00face v\u00fdstra\u017en\u00e9 vety (EUH211 a EUH212) a osobitn\u00e9 harmonizovan\u00e9 pou\u017eitie EUH210 pre niektor\u00e9 zmesi, ktor\u00e9 by inak neboli klasifikovan\u00e9 ako nebezpe\u010dn\u00e9.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Rozsudok V\u0161eobecn\u00e9ho s\u00fadu z 23. novembra 2022, n\u00e1sledne rozsudok S\u00fadneho dvora Eur\u00f3pskej \u00fanie z 1. augusta 2025 a n\u00e1sledn\u00e9 ozn\u00e1menia ECHA v\u0161ak <strong>definit\u00edvne ukon\u010dili<\/strong> harmonizovan\u00fa karcinog\u00e9nnu klasifik\u00e1ciu oxidu titani\u010dit\u00e9ho.<\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #333333;\">Aktu\u00e1lny stav klasifik\u00e1cie:<\/span><\/h4>\n<ul>\n<li style=\"text-align: justify;\">pr\u00edloha VI nariadenia CLP <strong>neobsahuje harmonizovan\u00fa klasifik\u00e1ciu \u201eCarc. 2; H351 (vd\u00fdchnutie)\u201d<\/strong> pre oxid titani\u010dit\u00fd,<\/li>\n<li style=\"text-align: justify;\">harmonizovan\u00e1 povinnos\u0165 pou\u017e\u00edva\u0165 <strong>EUH211, EUH212<\/strong> a s nimi s\u00favisiacu <strong>EUH210<\/strong> <strong>zanikla<\/strong>,<\/li>\n<li style=\"text-align: justify;\">av\u0161ak <strong>spolo\u010dnosti s\u00fa na\u010falej povinn\u00e9<\/strong> <strong>klasifikova\u0165 svoje v\u00fdrobky na z\u00e1klade vlastn\u00e9ho pos\u00fadenia riz\u00edk<\/strong> a v pr\u00edpade potreby m\u00f4\u017eu dobrovo\u013ene pou\u017e\u00edva\u0165 <a href=\"https:\/\/www.msds-europe.com\/sk\/vystrazne-upozornenie\/\">v\u00fdstra\u017en\u00e9 vety<\/a>.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\">Kroky pre spolo\u010dnosti pou\u017e\u00edvaj\u00face oxid titani\u010dit\u00fd<\/h2>\n<p style=\"text-align: justify;\">Z\u00e1nik harmonizovanej karcinog\u00e9nnej klasifik\u00e1cie neznamen\u00e1, \u017ee vd\u00fdchnutie prachu oxidu titani\u010dit\u00e9ho je bez rizika. <a href=\"https:\/\/www.msds-europe.com\/sk\/regulacne-zmeny-v-oblasti-chemickej-bezpecnosti\/\">Zmenu pr\u00e1vneho prostredia<\/a> je preto potrebn\u00e9 premietnu\u0165 aj do praxe.<\/p>\n<p>&nbsp;<\/p>\n<h4><span style=\"color: #333333;\">1. Rev\u00edzia a aktualiz\u00e1cia kariet bezpe\u010dnostn\u00fdch \u00fadajov (SDS)<\/span><\/h4>\n<ul>\n<li style=\"text-align: justify;\">Skontrolujte, \u010di sa pri dotknut\u00fdch l\u00e1tkach\/zmesiach uv\u00e1dza klasifik\u00e1cia <strong>Carc. 2; H351 (vd\u00fdchnutie)<\/strong> pre oxid titani\u010dit\u00fd v\u00fdlu\u010dne z d\u00f4vodu prevzatia predch\u00e1dzaj\u00facej harmonizovanej polo\u017eky CLP.<\/li>\n<li style=\"text-align: justify;\">Ak \u00e1no, po z\u00e1niku harmonizovanej klasifik\u00e1cie je potrebn\u00e9 odstr\u00e1ni\u0165 odkaz na pr\u00edlohu VI nariadenia CLP a klasifik\u00e1ciu znovu pos\u00fadi\u0165 na z\u00e1klade aktu\u00e1lnych poznatkov \u2013 v pr\u00edpade potreby formou vlastnej klasifik\u00e1cie.<\/li>\n<li style=\"text-align: justify;\">V s\u00falade s t\u00fdm je nutn\u00e9 upravi\u0165 oddiel 2 SDS (klasifik\u00e1cia, prvky ozna\u010dovania), pr\u00edslu\u0161n\u00e9 H-vety a \u010fal\u0161ie prvky komunik\u00e1cie nebezpe\u010dnosti.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><em>Potrebujete pomoc?<\/em><\/p>\n<p style=\"text-align: justify;\"><em>V r\u00e1mci na\u0161ich slu\u017eieb <a href=\"https:\/\/www.msds-europe.com\/sk\/karta-bezpecnostnych-udajov-revizie-aktualizacie\/\">aktualiz\u00e1cie SDS<\/a> alebo <a href=\"https:\/\/www.msds-europe.com\/sk\/zostavenie-a-vytvorenie-karty-bezpecnostnych-udajov\/\">vypracovania SDS<\/a> zabezpe\u010d\u00edme, aby SDS sp\u013a\u0148al najnov\u0161ie po\u017eiadavky REACH a CLP (aktu\u00e1lny status oxidu titani\u010dit\u00e9ho, z\u00e1kaz E171, povinnosti PCN at\u010f.).<\/em><\/p>\n<p>&nbsp;<\/p>\n<h4><span style=\"color: #333333;\">2. Je to obzvl\u00e1\u0161\u0165 d\u00f4le\u017eit\u00e9 v odvetviach, kde je oxid titani\u010dit\u00fd k\u013e\u00fa\u010dovou zlo\u017ekou (farby, n\u00e1tery, plasty, atramenty, stavebn\u00e9 materi\u00e1ly a pod.).<\/p>\n<p>&nbsp;<\/p>\n<h4><span style=\"color: #333333;\">5.
