H351 (vdechov\u00e1n\u00ed)<\/strong>\u201c.<\/p>\n<p style=\"text-align: justify;\">Francie a Evropsk\u00e1 komise podaly proti rozsudku Tribun\u00e1lu odvol\u00e1n\u00ed, av\u0161ak Soudn\u00ed dv\u016fr Evropsk\u00e9 unie rozsudkem ze dne 1. srpna 2025 ve spojen\u00fdch v\u011bcech C-71\/23 P a C-82\/23 P odvol\u00e1n\u00ed zam\u00edtl a rozhodnut\u00ed Tribun\u00e1lu potvrdil.<\/p>\n<p style=\"text-align: justify;\">Ozn\u00e1men\u00ed C\/2025\/6670 v <a href=\"https:\/\/www.msds-europe.com\/wp-content\/uploads\/2025\/12\/OJ_L_202502439_CS_TXT.pdf\">\u00da\u0159edn\u00edm v\u011bstn\u00edku Evropsk\u00e9 unie<\/a> stanov\u00ed praktick\u00e9 d\u016fsledky soudn\u00edch rozhodnut\u00ed pro p\u0159\u00edlohu VI na\u0159\u00edzen\u00ed CLP.<\/p>\n<p style=\"text-align: justify;\">Z toho vypl\u00fdv\u00e1, \u017ee harmonizovan\u00e1 klasifikace \u201e<strong>Carc. 2; H351 (vdechov\u00e1n\u00ed)<\/strong>\u201c zaveden\u00e1 na z\u00e1klad\u011b na\u0159\u00edzen\u00ed (EU) 2020\/217 pro <strong>oxid titani\u010dit\u00fd v pr\u00e1\u0161kov\u00e9 form\u011b obsahuj\u00edc\u00ed \u010d\u00e1stice s aerodynamick\u00fdm pr\u016fm\u011brem \u2264 10 \u03bcm v koncentraci alespo\u0148 1 %<\/strong> <strong>definitivn\u011b zanikla<\/strong> a p\u0159\u00edslu\u0161n\u00fd z\u00e1znam v t\u00e9to podob\u011b mus\u00ed b\u00fdt z p\u0159\u00edlohy VI na\u0159\u00edzen\u00ed CLP odstran\u011bn.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #333333;\">V n\u00e1vaznosti na rozsudek ECHA aktualizovala sv\u00e9 datab\u00e1ze:<\/span><\/strong><\/p>\n<ul>\n<li style=\"text-align: justify;\">harmonizovan\u00e1 karcinogenn\u00ed klasifikace oxidu titani\u010dit\u00e9ho byla odstran\u011bna z C&amp;L Inventory,<\/li>\n<li style=\"text-align: justify;\">z\u00e1znamy v Registry of Intentions byly odpov\u00eddaj\u00edc\u00edm zp\u016fsobem upraveny,<\/li>\n<li style=\"text-align: justify;\">pokyny agentury ECHA ke klasifikaci oxidu titani\u010dit\u00e9ho byly sta\u017eeny.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\">Co to znamen\u00e1 v praxi?<\/h2>\n<p style=\"text-align: justify;\">V praxi to znamen\u00e1, \u017ee v sou\u010dasnosti <strong>neexistuje v p\u0159\u00edloze VI na\u0159\u00edzen\u00ed CLP \u017e\u00e1dn\u00fd platn\u00fd harmonizovan\u00fd z\u00e1znam \u201eCarc. 2; H351 (vdechov\u00e1n\u00ed)\u201c pro oxid titani\u010dit\u00fd<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Spole\u010dnosti samoz\u0159ejm\u011b mohou <strong>nad\u00e1le prov\u00e1d\u011bt vlastn\u00ed klasifikaci na vlastn\u00ed odpov\u011bdnost<\/strong>, pokud na z\u00e1klad\u011b dostupn\u00fdch \u00fadaj\u016f a konkr\u00e9tn\u00edho pou\u017eit\u00ed v\u00fdrobku pova\u017euj\u00ed p\u0159\u00edsn\u011bj\u0161\u00ed komunikaci rizik za od\u016fvodn\u011bnou.<\/p>\n<p style=\"text-align: justify;\"><strong>D\u016fle\u017eit\u00e9 je,<\/strong> \u017ee zru\u0161en\u00ed harmonizovan\u00e9 klasifikace oxidu titani\u010dit\u00e9ho podle <a href=\"https:\/\/www.msds-europe.com\/cs\/obsahove-a-formalni-prvky-bezpecnostniho-listu\/\">CLP<\/a> <strong>nem\u00e1 vliv na z\u00e1kaz jeho pou\u017eit\u00ed jako potravin\u00e1\u0159sk\u00e9 p\u0159\u00eddatn\u00e9 l\u00e1tky (E171)<\/strong>, kter\u00fd vych\u00e1z\u00ed z odd\u011blen\u00e9 potravin\u00e1\u0159sk\u00e9 legislativy a stanoviska EFSA z roku 2021.<\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\">Nejd\u016fle\u017eit\u011bj\u0161\u00ed informace o oxidu titani\u010dit\u00e9m<\/h2>\n<p style=\"text-align: justify;\">Oxid titani\u010dit\u00fd (tak\u00e9 oxid titanu(IV); chemick\u00fd vzorec TiO\u2082) je b\u00edl\u00fd jemnozrnn\u00fd pr\u00e1\u0161ek, kter\u00fd se v p\u0159\u00edrod\u011b vyskytuje ve form\u011b miner\u00e1l\u016f rutilu nebo anatasu.<\/p>\n<p style=\"text-align: justify;\">Hlavn\u00edmi oblastmi pou\u017eit\u00ed jsou barvy a laky a d\u00e1le v\u00fdroba pap\u00edru a plast\u016f, kter\u00e9 dohromady p\u0159edstavuj\u00ed p\u0159ibli\u017en\u011b 80 % sv\u011btov\u00e9 spot\u0159eby oxidu titani\u010dit\u00e9ho. Dal\u0161\u00ed pigmentov\u00e9 aplikace, nap\u0159\u00edklad tiskov\u00e9 barvy, pry\u017e, kosmetick\u00e9 v\u00fdrobky a potraviny, p\u0159edstavuj\u00ed n\u011bkolik dal\u0161\u00edch procent.<\/p>\n<p style=\"text-align: justify;\">Zb\u00fdvaj\u00edc\u00ed \u010d\u00e1st se pou\u017e\u00edv\u00e1 v jin\u00fdch aplikac\u00edch, nap\u0159\u00edklad p\u0159i v\u00fdrob\u011b technicky \u010dist\u00e9ho titanu, skla a sklokeramiky, elektrokeramiky, kovov\u00fdch patin, katalyz\u00e1tor\u016f, elektrick\u00fdch vodi\u010d\u016f a chemick\u00fdch meziprodukt\u016f.<\/p>\n<p style=\"text-align: justify;\">Oxid titani\u010dit\u00fd je obl\u00edbenou slo\u017ekou n\u00e1t\u011brov\u00fdch hmot; podle odhad\u016f je obsa\u017een ve v\u00fdznamn\u00e9 \u010d\u00e1sti v\u0161ech komer\u010dn\u00edch barev.<\/p>\n<p style=\"text-align: justify;\">V kosmetice se v mal\u00fdch mno\u017estv\u00edch pou\u017e\u00edv\u00e1 jako zahu\u0161\u0165ovadlo a opacifik\u00e1tor, ve v\u011bt\u0161\u00edch mno\u017estv\u00edch pak jako fyzik\u00e1ln\u00ed UV filtr v opalovac\u00edch kr\u00e9mech, proto\u017ee oxid titani\u010dit\u00fd dok\u00e1\u017ee filtrovat i \u0161kodliv\u00e9 UV z\u00e1\u0159en\u00ed.<\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\">Oxid titani\u010dit\u00fd jako potravin\u00e1\u0159sk\u00e1 p\u0159\u00eddatn\u00e1 l\u00e1tka (E171)<\/h2>\n<p style=\"text-align: justify;\">Na z\u00e1klad\u011b na\u0159\u00edzen\u00ed (ES) \u010d. 1333\/2008 byl oxid titani\u010dit\u00fd d\u0159\u00edve povolen jako potravin\u00e1\u0159sk\u00e1 p\u0159\u00eddatn\u00e1 l\u00e1tka (barvivo) pod ozna\u010den\u00edm E171. Jeho \u00fa\u010delem bylo zv\u00fdraznit barvu potravin a zlep\u0161it vizu\u00e1ln\u00ed vzhled v\u00fdrobk\u016f.<\/p>\n<p style=\"text-align: justify;\">V letech 2016\u20132021 bylo publikov\u00e1no velk\u00e9 mno\u017estv\u00ed toxikologick\u00fdch studi\u00ed, se zvl\u00e1\u0161tn\u00edm zam\u011b\u0159en\u00edm na \u0161ar\u017ee TiO\u2082 potravin\u00e1\u0159sk\u00e9 kvality obsahuj\u00edc\u00ed tak\u00e9 nano\u010d\u00e1stice. Stanovisko EFSA zve\u0159ejn\u011bn\u00e9 dne 6. kv\u011btna 2021 dosp\u011blo k z\u00e1v\u011bru, \u017ee oxid titani\u010dit\u00fd ji\u017e nelze pova\u017eovat za bezpe\u010dn\u00fd jako potravin\u00e1\u0159skou p\u0159\u00eddatnou l\u00e1tku, zejm\u00e9na proto, \u017ee genotoxick\u00fd \u00fa\u010dinek nebylo mo\u017en\u00e9 s dostate\u010dnou jistotou vylou\u010dit.<\/p>\n<p style=\"text-align: justify;\">V n\u00e1vaznosti na to Evropsk\u00e1 komise p\u0159ijala na\u0159\u00edzen\u00ed (EU) 2022\/63, kter\u00fdm zm\u011bnila p\u0159\u00edlohy II a III na\u0159\u00edzen\u00ed (ES) \u010d. 1333\/2008: oxid titani\u010dit\u00fd (E171) byl vy\u0159azen ze seznamu povolen\u00fdch potravin\u00e1\u0159sk\u00fdch p\u0159\u00eddatn\u00fdch l\u00e1tek v EU. Podle na\u0159\u00edzen\u00ed je od 7. \u00fanora 2022 zak\u00e1z\u00e1no uv\u00e1d\u011bt na trh nov\u00e9 potraviny s p\u0159\u00eddavkem E171 a po 7. srpnu 2022 ji\u017e nesm\u011bly na trhu z\u016fstat ani potraviny obsahuj\u00edc\u00ed tuto l\u00e1tku.<\/p>\n<p style=\"text-align: justify;\">Z\u00e1kaz E171 tedy z\u016fst\u00e1v\u00e1 v platnosti a je zcela nez\u00e1visl\u00fd na aktu\u00e1ln\u00edm zru\u0161en\u00ed klasifikace oxidu titani\u010dit\u00e9ho podle CLP pro pr\u016fmyslov\u00e1 pou\u017eit\u00ed.<\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\">V\u00fdvoj klasifikace oxidu titani\u010dit\u00e9ho podle CLP \u2013 stru\u010dn\u00fd p\u0159ehled<\/h2>\n<p style=\"text-align: justify;\">Na\u0159\u00edzen\u00ed Komise v p\u0159enesen\u00e9 pravomoci (EU) 2020\/217, p\u0159ijat\u00e9 jako 14. ATP k na\u0159\u00edzen\u00ed CLP (ES) \u010d. 1272\/2008, bylo zve\u0159ejn\u011bno v \u00da\u0159edn\u00edm v\u011bstn\u00edku Evropsk\u00e9 unie dne 18. \u00fanora 2020 a bylo pou\u017eiteln\u00e9 od 1. \u0159\u00edjna 2021.<\/p>\n<p style=\"text-align: justify;\"><strong>Tato zm\u011bna:<\/strong><\/p>\n<ul>\n<li style=\"text-align: justify;\">zavedla novou polo\u017eku pro oxid titani\u010dit\u00fd v tabulce 3 \u010d\u00e1sti 3 p\u0159\u00edlohy VI na\u0159\u00edzen\u00ed CLP a klasifikovala oxid titani\u010dit\u00fd v pr\u00e1\u0161kov\u00e9 form\u011b obsahuj\u00edc\u00ed alespo\u0148 1 % oxidu titani\u010dit\u00e9ho a \u010d\u00e1stice s aerodynamick\u00fdm pr\u016fm\u011brem \u2264 10 \u03bcm jako karcinogen kategorie 2 (Carc. 2; H351 \u2013 \u201ePodez\u0159en\u00ed na vyvol\u00e1n\u00ed rakoviny (vdechov\u00e1n\u00ed)\u201c);<\/li>\n<li style=\"text-align: justify;\">sou\u010dasn\u011b zavedla dv\u011b nov\u00e9 dopl\u0148kov\u00e9 v\u011bty o nebezpe\u010dnosti (EUH211 a EUH212) a zvl\u00e1\u0161tn\u00ed harmonizovan\u00e9 pou\u017eit\u00ed EUH210 pro n\u011bkter\u00e9 sm\u011bsi, kter\u00e9 by jinak nebyly klasifikov\u00e1ny jako nebezpe\u010dn\u00e9.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Rozsudek Tribun\u00e1lu ze dne 23. listopadu 2022, n\u00e1sledn\u011b rozsudek Soudn\u00edho dvora Evropsk\u00e9 unie ze dne 1. srpna 2025 a n\u00e1sledn\u00e1 sd\u011blen\u00ed ECHA v\u0161ak <strong>definitivn\u011b ukon\u010dily<\/strong> harmonizovanou karcinogenn\u00ed klasifikaci oxidu titani\u010dit\u00e9ho.<\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #333333;\">Aktu\u00e1ln\u00ed stav klasifikace:<\/span><\/h4>\n<ul>\n<li style=\"text-align: justify;\">p\u0159\u00edloha VI na\u0159\u00edzen\u00ed CLP <strong>neobsahuje harmonizovanou klasifikaci \u201eCarc. 2; H351 (vdechov\u00e1n\u00ed)\u201c<\/strong> pro oxid titani\u010dit\u00fd,<\/li>\n<li style=\"text-align: justify;\">harmonizovan\u00e1 povinnost pou\u017e\u00edvat <strong>EUH211, EUH212<\/strong> a s nimi souvisej\u00edc\u00ed <strong>EUH210<\/strong> <strong>zanikla<\/strong>,<\/li>\n<li style=\"text-align: justify;\">nicm\u00e9n\u011b <strong>spole\u010dnosti jsou nad\u00e1le povinny<\/strong> <strong>klasifikovat sv\u00e9 v\u00fdrobky na z\u00e1klad\u011b vlastn\u00edho posouzen\u00ed rizik<\/strong> a v p\u0159\u00edpad\u011b pot\u0159eby mohou dobrovoln\u011b pou\u017e\u00edvat <a href=\"https:\/\/www.msds-europe.com\/cs\/standardni-vety-o-nebezpecnosti-h\/\">v\u011bty o nebezpe\u010dnosti<\/a>.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\">Doporu\u010den\u00e9 kroky pro spole\u010dnosti pou\u017e\u00edvaj\u00edc\u00ed oxid titani\u010dit\u00fd<\/h2>\n<p style=\"text-align: justify;\">Z\u00e1nik harmonizovan\u00e9 karcinogenn\u00ed klasifikace neznamen\u00e1, \u017ee vdechov\u00e1n\u00ed prachu oxidu titani\u010dit\u00e9ho je bez rizika. <a href=\"https:\/\/www.msds-europe.com\/cs\/regulacni-zmeny-v-oblasti-chemicke-bezpecnosti\/\">Zm\u011bnu pr\u00e1vn\u00edho r\u00e1mce<\/a> je proto pot\u0159eba prom\u00edtnout i do praxe.<\/p>\n<p>&nbsp;<\/p>\n<h4><span style=\"color: #333333;\">1. Revize a aktualizace bezpe\u010dnostn\u00edch list\u016f (SDS)<\/span><\/h4>\n<ul>\n<li style=\"text-align: justify;\">Ov\u011b\u0159te, zda je u dot\u010den\u00fdch l\u00e1tek\/sm\u011bs\u00ed uvedena klasifikace <strong>Carc. 2; H351 (vdechov\u00e1n\u00ed)<\/strong> pro oxid titani\u010dit\u00fd pouze z d\u016fvodu p\u0159evzet\u00ed d\u0159\u00edv\u011bj\u0161\u00ed harmonizovan\u00e9 polo\u017eky CLP.<\/li>\n<li style=\"text-align: justify;\">Pokud ano, s ukon\u010den\u00edm harmonizovan\u00e9 klasifikace je t\u0159eba odstranit odkaz na p\u0159\u00edlohu VI na\u0159\u00edzen\u00ed CLP a klasifikaci znovu posoudit na z\u00e1klad\u011b aktu\u00e1ln\u00edch poznatk\u016f \u2013 v p\u0159\u00edpad\u011b pot\u0159eby formou vlastn\u00ed klasifikace.<\/li>\n<li style=\"text-align: justify;\">V souladu s t\u00edm je nutn\u00e9 upravit odd\u00edl 2 SDS (klasifikace, prvky ozna\u010dov\u00e1n\u00ed), p\u0159\u00edslu\u0161n\u00e9 H-v\u011bty a dal\u0161\u00ed prvky komunikace nebezpe\u010dnosti.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><em>Pot\u0159ebujete pomoc?<\/em><\/p>\n<p style=\"text-align: justify;\"><em>V r\u00e1mci na\u0161ich slu\u017eeb <a href=\"https:\/\/www.msds-europe.com\/cs\/bezpecnostni-list-revize-aktualizace\/\">aktualizace SDS<\/a> nebo <a href=\"https:\/\/www.msds-europe.com\/cs\/sestaveni-vytvoreni-bezpecnostniho-listu\/\">tvorby SDS<\/a> zajist\u00edme, aby SDS odpov\u00eddal nejnov\u011bj\u0161\u00edm po\u017eadavk\u016fm REACH a CLP (aktu\u00e1ln\u00ed status oxidu titani\u010dit\u00e9ho, z\u00e1kaz E171, povinnosti PCN apod.).<\/em><\/p>\n<p>&nbsp;<\/p>\n<h4><span style=\"color: #333333;\">2. Nevdechujte prach.\u201c) byly zavedeny v souvislosti s d\u0159\u00edv\u011bj\u0161\u00ed harmonizovanou klasifikac\u00ed oxidu titani\u010dit\u00e9ho na\u0159\u00edzen\u00edm (EU) 2020\/217 (p\u0159\u00edloha I).<\/p>\n<p style=\"text-align: justify;\">Proto\u017ee tato harmonizovan\u00e1 klasifikace v d\u016fsledku soudn\u00edch rozhodnut\u00ed <strong>pozbyla platnosti<\/strong>, pou\u017eit\u00ed EUH211 a EUH212 (a souvisej\u00edc\u00edho EUH210) pouze z d\u016fvodu p\u0159\u00edtomnosti oxidu titani\u010dit\u00e9ho <strong>ji\u017e nen\u00ed povinn\u00e9<\/strong>.<\/p>\n<p style=\"text-align: justify;\">V\u00fdrobci se v\u0161ak mohou na z\u00e1klad\u011b vlastn\u00edho posouzen\u00ed rizik rozhodnout tyto v\u011bty nad\u00e1le uv\u00e1d\u011bt dobrovoln\u011b, zejm\u00e9na u aplikac\u00ed se siln\u00fdm pra\u0161en\u00edm nebo p\u0159i aerosolov\u00e9m pou\u017eit\u00ed.<\/div><\/div>\n<p style=\"text-align: justify;\"><div class=\"su-spoiler su-spoiler-style-fancy su-spoiler-icon-chevron su-spoiler-closed\" data-scroll-offset=\"0\" data-anchor-in-url=\"no\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span>Je oxid titani\u010dit\u00fd bezpe\u010dn\u00fd jako potravin\u00e1\u0159sk\u00e1 p\u0159\u00eddatn\u00e1 l\u00e1tka (E171)?<\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p style=\"text-align: justify;\">Na z\u00e1klad\u011b stanoviska EFSA z roku 2021 ji\u017e oxid titani\u010dit\u00fd (E171) <strong>nelze pova\u017eovat za bezpe\u010dn\u00fd<\/strong> jako potravin\u00e1\u0159skou p\u0159\u00eddatnou l\u00e1tku, zejm\u00e9na kv\u016fli nejistot\u00e1m t\u00fdkaj\u00edc\u00edm se genotoxicity.<\/p>\n<p style=\"text-align: justify;\">N\u00e1sledn\u011b Evropsk\u00e1 komise p\u0159ijala na\u0159\u00edzen\u00ed (EU) 2022\/63, kter\u00e9 zm\u011bnou p\u0159\u00edloh II a III na\u0159\u00edzen\u00ed (ES) \u010d. 1333\/2008 <strong>zru\u0161ilo povolen\u00ed E171<\/strong>: od 7. srpna 2022 ji\u017e v EU nelze uv\u00e1d\u011bt na trh v\u00fdrobky obsahuj\u00edc\u00ed oxid titani\u010dit\u00fd jako potravin\u00e1\u0159skou p\u0159\u00eddatnou l\u00e1tku.<\/p>\n<p style=\"text-align: justify;\">Tento z\u00e1kaz v oblasti potravinov\u00e9ho pr\u00e1va je zcela <strong>nez\u00e1visl\u00fd<\/strong> na zru\u0161en\u00ed klasifikace oxidu titani\u010dit\u00e9ho podle CLP;
